Must private investigation be addressed in the work regulations?

From 16 December 2026, an employer wishing to commission a private investigation concerning an employee must expressly and transparently define the authorisation and applicable rules in an internal regulation, such as a collective labour agreement, the work regulations or a works council decision. The specific implementation should be legally reviewed.
