Investigation into a Possible Breach of a Non-Solicitation Clause
Situation
A company active in the logistics sector discovered that several employees had terminated their employment contracts within a short period and subsequently joined a competing company.
The cooperation agreement between the two companies contained a contractual non-solicitation clause, prohibiting either party from actively recruiting staff from the other party for a specified period.
The client requested an investigation to determine whether there were indications that the competitor had possibly breached this clause.
Investigation Assignment
JOCO Investigations was instructed by the client to collect objective and verifiable information regarding:
possible contacts between the employees involved and the competing company
the circumstances surrounding the departure of the employees
possible indications of active recruitment or solicitation
The investigation was carried out in accordance with the Belgian Private Investigation Act (18 May 2024) and within the legal framework of data protection regulations.
Investigation Activities
As part of the investigation, the following steps were carried out:
analysis of publicly available information (OSINT)
verification of the professional activities of the individuals concerned
observations at relevant locations
documentation of factual findings
All findings were carefully documented.
Result
The results of the investigation were compiled in a structured investigation report summarising the activities carried out, the factual findings and the relevant elements for the case.
The report was delivered to the client so it could be evaluated in the context of a possible legal procedure.
